Cherera Four acted wrongfully- Muchelule-led Tribunal rules

The Aggrey Muchelule- led tribunal that was formed to consider the conduct of the Cherera four commissioners of the Independent Electoral and Boundaries Commission (IEBC)

Juliana Cherera, Francis Wanderi, Irene Masit and Justus Nyang’aya had disputed the presidential election results as announced by the then IEBC Chairman Wafula Chebukati terming the opaque nature in which the results were arrived at.

After the Supreme court upheld the disputed elections in favor of William Ruto, a petition for their removal was filed as it challenged their suitability to hold the offices.

Initially, the petition was targeting all the four commissioners who disputed the election results as announced by their chairman Wafula Chebukati but only Masit remained to face the tribunal as the other three resigned.

 

The tribunal has since made public their recommendations and they urge the removal of Irene Masit, the only commissioner remaining after the resignation of Juliana Cherera, Justus Nyang’aya and Francis Wanderi. Commissioners Boya Molu and Abdi Guliye have since retired after their terms in office expired.

“Having considered all the evidence tendered, the Tribunal finds that the allegations on serious violation of the constitution and the law… against Commissioner Irene Masit have been proved to the required standard,” the tribunal said.

 

“Now therefore, this Tribunal recommends to Your Excellency, the President of the Republic of Kenya and Commander in Chief of the Defence Forces, pursuant to the mandate assigned vide Gazette Notice No. 14890 of 2nd December 2022, and further in accordance and in compliance with Article 251(1) and (6) that Commissioner Irene Cherop Masit be removed from office as a member of the Independent Electoral and Boundaries Commission.” read part of their recommendations forwarded to the president for action
